This site could and should be more complete about this issue, of K Harris’s ineligibility for the office – either the higher one, or the one that she currently occupies illegally.
First of all, there is no such legal thing as an ‘anchor baby’. The 14th Amendment reads: “All persons born or naturalized in the United States, AND SUBJECT TO THE JURISDICTION THEREOF, are citizens of the United States and of the State wherein they reside…” My emphasis, of the phrase that has been conveniently overlooked over too many years, now. Babies born in the U.S. of the likes of illegal aliens, visitors, diplomats etc. are “subject to the jurisdiction “of their parents’ home countries. A subsequent decision by the SCOTUS (Wong Kim Ark, 1898) confused the issue a bit; but the bottom line in this whole particular mess is that K Harris is not eligible for either of these two federal offices ANYWAY, for not being a particular kind of citizen: a ‘natural born’ citizen.
What is a nbc? It is a person “born in the country, OF PARENTS WHO ARE CITIZENS” thereof (my emphasis). The definition is from the definitive tome of the day of the constitutional Framers on such nation-building matters, E. de Vattel’s ‘The Law of Nations;’ which the Framers made as an eligibility requirement for the office of SCOTUS (and which was added later, by amendment, logically, for the occupant of the office of VP, since that person might accede to the higher office). And that requirement for those two federal offices –
and those two only; indicative of their special nature in the eyes of the Framers (having to do with the fact that the occupant of the higher office becomes as well, then, the Commander in Chief of the nation’s military forces, and the Framers didn’t want anybody in that position who had any DUAL OR OTHERWISE CONFLICTING LOYALTIES OR ALLEGIANCES OR INFLUENCES. Rather, only someone who had SOLE ALLEGIANCE to the U.S.) –

The astute reader will already have noted that this eligibility issue applies as well to BHO. Which is, indeed, a bit of unfinished business in this country.
